TeacherGPT Terms of Use

Welcome to TeacherGPT. These Terms of Use ("Terms") govern your access to and use of TeacherGPT, including any content, functionality, and services offered on or through our website and application (the "Service").
Please read these Terms carefully before using our Service. By accessing or using TeacherGPT, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Service.

The Service is intended solely for users who are 18 years of age or older and who are teachers or educational professionals. By using the Service, you represent and warrant that you meet these requirements.

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

TeacherGPT provides AI-generated content to assist teachers. As a user, you acknowledge and agree that:

1. All content generated by the Service is created by artificial intelligence and may contain errors, inaccuracies, or inappropriate material.
2. You are solely responsible for reviewing, verifying, and approving all content generated by the Service before using it in your educational setting.
3. You must exercise your professional judgment when using any content or suggestions provided by the Service.
4. You will not use the Service to generate content that violates any laws, regulations, or educational institution policies.

You are responsible for all content and information you provide to the Service. You agree not to submit:

1. Personally identifiable information about your students.
2. Sensitive information protected by privacy laws.
3. Content that infringes intellectual property rights.
4. Any illegal, harmful, abusive, or otherwise objectionable content.

You agree not to use the Service:

1. In any way that violates any applicable laws or regulations.
2. To impersonate any person or entity.
3. To attempt to gain unauthorized access to any part of the Service.
4. To engage in any activity that interferes with or disrupts the Service.
5. To reverse engineer or attempt to extract the source code of the Service.
6. For any commercial purpose without our prior written consent.

The Service itself, including its software, interface, design, logo, and branding elements are owned by TeacherGPT and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of the TeacherGPT platform itself, or use our branding without permission.

You own and are free to use all content generated by TeacherGPT for you (such as lesson plans, worksheets, teaching materials, etc.). You may download, modify, reproduce, distribute, display, and use these materials for your educational purposes both within and outside your classroom or educational institution. You may incorporate them into your teaching materials, share them with colleagues, and adapt them as needed.
While you may freely use the generated content, you may not claim that the AI-generated materials were created entirely by you for purposes of publication or professional credit.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT:

1. THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
2. THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, OR MEET YOUR REQUIREMENTS.
3. THE QUALITY OF THE CONTENT, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.
4. ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEACHERGPT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

1. ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
2. ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
3. ANY DAMAGES RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.
4. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
5. ANY CONTENT OBTAINED FROM OR THROUGH THE SERVICE.
6. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN PARTICULAR, TEACHERGPT SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY, OR HARM ARISING FROM:

1. THE USE OF AI-GENERATED CONTENT IN EDUCATIONAL SETTINGS.
2. ANY ERRORS, INACCURACIES, OR INAPPROPRIATE CONTENT GENERATED BY THE SERVICE.
3. ANY CLAIMS BY STUDENTS, PARENTS, EDUCATIONAL INSTITUTIONS, OR OTHER THIRD PARTIES RELATING TO THE USE OF CONTENT GENERATED BY THE SERVICE.
4. ANY VIOLATIONS OF EDUCATIONAL POLICIES, REGULATIONS, OR STANDARDS RESULTING FROM THE USE OF THE SERVICE.

You agree to defend, indemnify, and hold harmless TeacherGPT, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

1. Your use of the Service.
2. Your violation of these Terms.
3. Your violation of any rights of another.
4. Your use of AI-generated content in educational settings, including any claims relating to errors, inaccuracies, or inappropriate content.

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of New Zealand, and you consent to the personal jurisdiction of such courts

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes to these Terms, we will update the "Last Updated" date at the top of the Terms.
When you log in following any changes to the Terms, you will be notified of the updates and required to accept the new Terms before continuing to use the Service. Your continued use of the Service after accepting the revised Terms confirms your acceptance of these changes.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or prevent us from enforcing such rights at a later time.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TeacherGPT regarding our Service and supersede all prior agreements and understandings, whether written or oral.
